There is the (admittedly old-fashioned) rule of law that "ignorance of the law is no excuse." I agree that certain areas are sufficiently gray that they might rely on legal opinions of the high authorities, but this gray is closer to white than to black.

I don't trust Zelikow. If such a memo exists, let him produce it and let's take some care that the memo is genuine -- written in 2005 as opposed to 2009.

Recall that the CIA had engaged in its activities for decades before the torture memos had existed. They were all intimately involved with torturers, organized crime, military takeovers, drug-dealing, etc.
